Welcome to HR Engine! By accessing or using our services, you agree to comply with and be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use the service.
HR Engine is an AI-powered SaaS platform designed to streamline and automate recruitment interviews. These Terms & Conditions govern your use of our platform, tools, and services.
2. Definitions
"Service" refers to the HR Engine platform, tools, and all associated features.
"User" refers to the individual or entity accessing the Service.
"Content" refers to all information, data, text, or other materials uploaded or created through the Service.
"Subscription" refers to the paid plans offered for access to the Service.
3. User Responsibilities
Account Security: Users are responsible for maintaining the confidentiality of their account credentials. You agree to notify HR Engine immediately of any unauthorized use of your account.
Compliance: Users must comply with all applicable laws and regulations when using the Service.
Prohibited Use: Users may not use the Service to upload harmful, unlawful, or infringing content, or interfere with the platform's functionality.
4. Subscription & Payment
Billing: Subscriptions are billed on a recurring basis (monthly or annually) as specified during registration. All payments are non-refundable unless otherwise stated in this agreement.
Auto-renewal: Your subscription will renew automatically unless canceled at least 5 business days prior to the next billing cycle.
Payment Failure: Failure to process payment may result in suspension or termination of your access to the Service.
Price Changes: HR Engine reserves the right to modify subscription fees with 30 days notice to users.
5. Data Privacy & Security
User Data: Users retain ownership of all data uploaded to the platform. HR Engine acts as a processor of this data under applicable data protection laws.
Confidentiality: HR Engine will implement commercially reasonable measures to protect user data from unauthorized access, disclosure, or misuse.
Data Usage: HR Engine may use anonymized and aggregated data for analytics, research, and service improvement purposes. No personally identifiable information will be shared without consent.
Third-party Integrations: HR Engine is not responsible for data breaches or misuse arising from third-party integrations chosen by the user.
6. Intellectual Property
Platform Ownership: HR Engine retains all intellectual property rights to the platform, including software, branding, and documentation. Users are granted a non-exclusive, non-transferable license to use the Service under these terms.
Prohibited Use: Users may not reverse-engineer, copy, distribute, or create derivative works from the platform without explicit permission.
User Content: By using the Service, you grant HR Engine a worldwide, royalty-free license to use, host, and process your content solely for providing the Service.
7. Service Availability
Uptime: HR Engine aims to provide 99.9% uptime but cannot guarantee uninterrupted service. Downtime for maintenance or unexpected issues will be minimized.
Limitation: HR Engine is not responsible for delays, interruptions, or data loss caused by third-party hosting providers or force majeure events.
8. Disclaimer of Warranties
As-Is Service: The Service is provided "as-is" without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
AI Limitations: HR Engine does not guarantee the accuracy or reliability of AI-driven recommendations or insights. Users should validate all outputs independently.
9. Limitation of Liability
HR Engine shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of the Service.
In no event shall HR Engine's total liability exceed the fees paid by the user in the preceding 12 months.
10. Termination
HR Engine may terminate or suspend access to the Service for violations of these Terms or failure to pay subscription fees.
Upon termination, users must cease all use of the Service, and HR Pal may delete associated data after 30 days.
11. Indemnification
Users agree to indemnify and hold harmless HR Engine, its affiliates, and employees from claims, damages, or liabilities arising from their use of the Service.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of France. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of France.
13. Changes to Terms
HR Engine reserves the right to modify these Terms & Conditions at any time. Users will be notified of significant changes via email or on the platform. Continued use of the Service constitutes acceptance of the updated terms.
